My question involves a child custody case from the State of: MI
I haven't seen my exact situation represented here and want to know what my options are.
My exhusband and I have shared joint physical and legal custody of our two children, now 13 and 9, for 9 years. We never had a written plan, but he generally had the kids 2 day out of the week...and then sometimes in Summer he'd have them 3 day per week. But the last couple years have been that he picks the kids up at 7 pm on Saturday and drops them off at 7 am Monday (two nights, one day- 36 hours per week). They go to the local schools from my house and I pay for everything, health insurance, sports, clothes, field trips, school lunches, etc. He has never contributed and since I make more money than him I just accepted it. Lately he has failed to pick up the kids at his scheduled time and the last time never even called to say he wouldn't be picking up. Now I'm hearing from the kids that he might be moving out of state very soon (we assume Florida) but he has not responded to my requests for some details. My concern is that if we still technically have joint custody, but he lives 1200 miles away and my husband and I take the kids often out of the country on trips to Europe, cruises and to our vacation home in the Caribbean, do I still have to get permission to take the kids on trips and renew their passports? Should I ask him to relinquish custody so that I have the freedom to continue to give my children opportunities to travel? If he doesn't want to what are my options?
