My question involves a traffic ticket from the state of: Tennessee
So, I was driving home and there was a truck driving close behind me, I turned on my blinker and turned into my driveway only to be slammed into by this truck. He hit me in the rear passenger side of my car, flipped me over the curb and my mailbox and ruined my car. The back windshield is gone, my daughters car seat is covered in glass (she wasn't present at the time of the accident), the whole back bumper is destroyed and the entire rear passenger door is smashed in. The Mailbox was up heaved from the ground and scrapped along the bottom of my car. I had an officer come and take a report, he didn't take a statement from either of the two witnesses and did not write a citation at the time. I called my own insurance, filed a claim, and did the same with the other driver's insurance as soon as I got the police report. The report was all wrong and I spent days trying to contact the police department to fix this. The insurance adjuster did not send anyone out to investigate and denied liability based on the report alone. Once I finally met with the officer's supervisor, I learned he was a newer officer, not a traffic officer and had been confused when writing the report and his supervisor was on vacation at the time so he couldn't catch it until now. They kindly fixed everything for me, made it perfectly clear that he was at fault on the report and I quickly submitted the new report to the adjuster. Once I did, the adjuster was very rude, she made it clear that she did not have to agree with the new report and she would have to do an investigation but would most likely not change her decision, she sent out someone to investigate the car, who made it clear that the damage was much worse than in his notes and their driver was clearly at fault... So he estimated around $3300 that they would be giving me to replace my vehicle, IF she decides to change her decision and accept liability. Now all while this is happening, I have no way to get my daughter to daycare, do the things I need and I have had to postpone school due to having no way to get there. I am out of a job and unable to get a rental myself, so I am stuck, I only have liability insurance for myself, so if she denies me again, I will be without a form of transportation and all I did was turn into my driveway. What can I do? Her supervisor doesn't care about my concerns and shrugged off my complaints, and my adjuster has made it clear that she doesn't care about the evidence, police report, or that my life is on hold due to this.
