My question involves a child custody case from the State of: Michigan (we don't have a case through FOC anymore)
My sons father has been dating a woman for the past year. I decided by how she talked about me on Facebook, by slamming me and calling myself and my sons half brothers, mom horrible names; that I wasn't very found of her. I brought it up with my ex, and he said she wasn't talking about me or **** mom. Well turns out she was. And she continued to do it for a few days. This was during the winter. So a few weeks ago my son tells me (he is 6) that he stayed the night at the gf's house. I said OH... So when I called my sons father he said "Oh I forgot to tell you..." Yeah ok. So last night I told my sons dad that I can just keep him overnight here and he can pick him up after work on Saturday. He said ok. I decided to listen to my instincts and I looked up this girl on public court dockets here in a small county in Michigan. I was expecting to find some speeding tickets or something, but what I found was incredible.
--The first charge in 2010 (which lasted until 2012) was for Domestic Violence on a spouse.
**During this time she has a few bench warrants for failing to appear to court**
--The second charge was in 2010 Giving fake ID to a police officer.
--The third charge was driving with a suspended license in 2011.
--The fourth charge was Larceny in the 3rd degree in 2012.
--The fifth charge was last year in 2015 for 3rd degree larceny.
During a few of these instances she did time in jail and failed during her probation and was ordered back to jail. She spent over 120 days in jail during the last 6 years.
Am I crazy for not wanting my son around this woman. She has four kids of her own. I don't care about her kids, No offense, those are her kids. But I do care about my son and I don't want my son around her, or staying with her when I am clearly available to watch my own son when his dad is at work.
I guess my question is if I take my self back to FOC and start my case again, would the court decide in favor of me not wanting my son with this woman?
