My question involves an injury that occurred in the state of: Arkansas
I was in a parking lot accident. I was driving down the aisle when another driver backs out and we collided. The police was called and a report was filed. Long story short, I filed a claim and it was denied because they said they had a witness that said the driver was already out of the parking space and proceeded to move forward when I hit her. I told them this witness was a friend and coworker of the other driver and she came outside from the rental office after the police was already there. They said they will investigate. They investigated by calling the other driver to see if they were friends. Of course they denied being friends, but admitted to working for the same company. Then They tell me witness or not you said in you were statement you were going 20-25 which is to fast for a parking lot even though there is no speed limit. So they feel I am equally at fault. Since I only have liability my insurance can only defend me but not fight, or do a litigation for me. Should I take this to small claims and what do I need to show or prove in order to win this case.
