My question involves criminal law for the state of: Pennsylvania
I work with a partner in a dental practice and noticed that fraud was occurring through billing procedures that were done by one doctor not credentialed with the insurance company and billed under other doctors (including me) for the procedures. My partner and the woman doing the billing are close and I am afraid that they may try to say I was involved if I try to report this.
I would like to have evidence that I was not involved by messaging them about what I have found. When we text each other we primarily use Whatsapp. Is there any other way I can get evidence of them admitting that it was them and not me involved in the fraud?
I would like to know if messages I get on Whatsapp can be used in court? They now have end to end encryption, meaning Whatsapp can't hand over the messages on their servers. I would be giving permission for my messages on my phone to be seen, but for it to be evidence do they need the other person's phone too?
Could the other side argue that those messages were not sent by them if Whatsapp can't hand over what is on their servers?
I would appreciate any opinions on this before I proceed with gathering evidence.
