My question involves adoption law for the State of California.
My husband is trying to adopt my twin daughters. The twins will be 4 in September. The biological father was out of their lives 8 months in. The stepfather started in their lives 10 months in. He is the only dad they remember. The last time the girls saw the biological dad is at 11 months old. He has made no attempts to visit or contact the children. He has been arrested 4 times with misdemeanor charges. One was a felony that was reduced to a misdemeanor. My question is this:
How do we prove abandonment? Is the burden of proof on the biological father? It's not possible to have evidence of someone NOT trying to visit or contact.
