My question involves paternity law for the State of: Louisiana
A friend of mine was in a relationship with a lady for lil longer than 2 years . They broke up for a week , she slept with someone else and became pregnant .
My friend and this lady got back together and she didn't tell him she had slept with someone else while they were broken up . She gave birth , the child took his last name and he is listed as father on the birth certificate and knows nothing of the other man.
the mother was arrested and served 2 years in prison shortly after giving birth and lost her parental rights and hasn't seen the child , talked to the father or fought for her paternal rights in the 2 years she has been out of prison .My friend has been raising the child for the last 4 years on his own .
The child is now 4 years old and the man the mother had slept with the week her and the father were broken up is now claiming he is the child's father and is ordering a DNA test .
My question in this case is what would happen if the man claiming he is the father , turns out to be the child's biological father . Will the man raising the child for the past 4 years of the child's life loose his rights or even his child . Can the mother be charged for withholding information ? She has said multiple times that the child was for the other man to people just not to the child's father . She has never told him .
