My question involves defamation in the state of: Iowa
Greetings,
I have a guy that's been harassing me online (craigslist ads) since I stood up for a fellow photographer a few months ago. His previous craigslist posts were only harassment so I simply flagged them and had them pulled from craigslist. Two days ago I discovered he'd made a fake Facebook page titled "Xxxxx Xxxxx Photography is a FRAUD." There was only one post which said "This page is all about informing the public that Xxxxx Xxxxx steals photographs from Facebook and claim them as his own." Since I I have never stolen an image and passed it off as mine, and I have all of the original RAW image files for everything ever posted on my FB Photography page, this crossed the line from harassment into libel. I reported the page to Facebook and it was pulled the next day.
On March 24, 2016 he posted an ad to the local craigslist photo/video section with an ad titled "Do not do business with Xxxxx Xxxxx Photography" He included the following libel per se statements: "He also steals pictures from people to claim as his own", "taking inappropriate pictures of children", "known to stalk women so he can try and rape them" and "also a pedophile."
I want to keep this in Iowa Small Claims because the guy is a loser and I doubt I can recover the cost of hiring an attorney to handle this. With Iowa Small Claims I'm limited to $5000 plus court costs per filing. Should I file a separate lawsuit for each statement, a lawsuit to cover FB and another for craigslist, or just lump it all together in one filing?
Obviously he never signed his name to the craigslist or FB posts, so how do I get craigslist and FB to hand over ISP info? Do I file in small claims and then ask them to file subpoenas to get that information?
Thanks for your help.
