My question involves defamation in the state of: New Mexico
This is a continuation of my sorry saga, so a recap.
I was a cop and told to return a load of drug paraphernalia to the family of the person imprisoned for using it to grow marijuana.
I refused but was later told by my immediate supervisor to destroy it, which I did with a court order.
I was demoted and suspended without pay for insubordination and the destruction of property.
Got an attorney who filed a tort claim with the city who employed me.
The tort was a little vague as it did not specify the details of my claim.
I quit.
Ten months later I had an interview with the Department of Public Safety, who are in charge of law enforcement officers certification.
Totally cleared me of any wrongdoing and they confirmed that I had been given an illegal order.
The chief of police sent the DPS a letter telling them they didn't know what they were talking about and then proceeded to libel me.
My attorney then let me know that despite all his e-mails telling me how hard he was working he had in fact done absolutely nothing with my case and didn't want to represent me.
I filed a formal complaint with the New Mexico Bar Association who agreed that he didn't do his job and they were going to send him a strongly worded letter as a severe punishment!!!!
Attempted to find a local competent attorney. In fact I'm still trying as in my town attorney and competent are not synonymous.
Now the question.
Would the chiefs libel made 10 months after the tort claim being sent require a second tort claim or will the first one still cover it.
