My question involves defamation in the state of: California
Someone published Libel posts on me to a group of about 200 people. Those posts were made from one person's phone, but they might have been made by another person using that person's phone.
My question is - who is accountable for the libel post - the person whose phone was used (and allowed the other person to make posts) or the person who actually made the post?
Also, is it required to ask the person who published the libel to make a retraction before filing a lawsuit?
