My question involves criminal law for the state of: NEW YORK
A large & reputable auction house in NYC recently sold a one of a kind item (to the tune of over $92,000) that belongs to me. The item was reported stolen in 2006, I know that is a long time ago but it is irrefutably ours.
The auction for the item included the original box, sales receipt with my name on it, AND it was engraved with my name. We have spoken with the legal advisor for the auction house and they are placing full blame on the person who consigned it, they (the auction house) are just the middle man and they "aren't responsible" for the sale of stolen merchandise. However, I find it odd that the legal advisor said "it's irrefutably yours so we won't need much to prove ownership of title other than the police report" yet somehow during the provenance process no red flags were thrown. They said, with an added statement that they cannot provide legal advise, BUT at this point i should hold off on legal counsel. I disagree.
What type of lawyer would handle this? Can I hold the auction house responsible for selling stolen goods? We all know there is no way the seller/consignor is going to hand over the $90K in profit to me for selling MY stolen property. Due to auction house confidentiality I am not at liberty to learn the name of the person who sold it. Majorly frustrating. Any advice would be GREATLY appreciated.
