Loan Agreements: How to Recover Money Lent to a Friend

My question involves collection proceedings in the State of: North Dakota*

I star that because at the moment he is in South Carolina and I am in Massachusetts but the transaction occurred in North Dakota, where we were both considered full-time residents at the time.

The short version is he wanted to borrow $5000 to pay for fuel for a tractor trailer to be able to get some work for the company he was driving for.

Apparently the owner of the company.... well the boss... had done some work for some businesses in the area and was not paid. This trickled down to equipment and employees (not being maintained, not getting paid, etc.) Because my buddy has a good heart he wanted to do this for him. And I would be paid back in a couple of weeks + $500. Turns out the boss's wife legally owns the company he created and they were having some issues with their marriage.

So the whole thing falls apart, my buddy wants to repay me but can't seem to find a decent paying job and chases business dreams to get the big pay day. His wife is jealous and would rather spend the day tracking him down making sure he doesn't do any funny business than work. I've witnessed her going crazy on him over the phone because he's spent too much time with me at dinner. He couldn't possibly still be with me, and so on.

So basically from my understanding for most people in my situation we're stuck. There is no action to take.

BUT, I have recorded all our calls and meetings. The meeting took a little effort, as in I had to flip the switch on/off on a pen, but for calls this is a passive thing. All my calls are recorded on my phone. And, to my knowledge ND is a one-party consent state.

This would be really awesome if I still had the first recording but that phone had died and the data was not on the SD card but main memory. That is probably the most important as it spelled out the verbal contract essentially. But the meeting has, I think enough info in it. Basically acknowledges we had an agreement of some sort, he felt bad and wants to pay $1000 instead of $500.

I'm actually trying to get in touch with him to work it out but if not can I pursue any legal route?
