My question involves education law in the State of: Ohio
Okay, so here is my situation. The semester recently ended at my school and in one of my classes after all of the grades were tallied I had an 86% in the course. This percentage, according to the syllabus, is a B. The issue is that my professor gave me a C.
I contacted my professor and asked how I got a C when I had an 86% and here is what he said. "The syllabus is just a guide for how I evaluate the course. I reserve the right to assign a grade based off of a holistic view of how you did."
In response to this I submitted an appeal to both the departmental and divisional deans. After arguing my case at the hearing, both deans agreed with me and submitted recommendations to the professor to change my grade on the principle in the student handbook that says "The syllabus is intended to a serve as a contract between a student and his/her professor over how a course is to be assessed." My professor still refuses to change the grade because another clause in the student handbook says that professors have the final say despite recommendations from any other authority. Would I have any kind of chance suing him in court? Thanks!
