My question involves an injury that occurred in the state of: California
Hi All,
My wife got into a car accident earlier this year. To summarize it, the insurance companies determined it to be her fault (and I am still contesting it since the police report is poorly written). Our insurance company has been talking to the injured parties attorney which she sustained almost $90K in injuries. So our insurance company got back to me and requested if I was OK with offering the injured party our policy limit, which we did. We showed cooperation. The limit is not enough to cover the entire amount but we offered the max our limit covers.
Fast forward to 2 months later, we got a letter from my insurance company that they forwarded to us from the injured party's attorney asking us to sign a piece of paper and initial each bullet item and send back to them something like:
1) You were not using the car at the time of accident for work
2) You were insured at the time the accident occured
3) *** I cant remember what 3 was ***
4) At the time of accident, you do not own any real estate that can be garnished
The one that struck me was #4, I'm not sure what they are trying to do are they planning on suing us ? Because we do own real estate which is our primary home.
Any help or feedback from attorney's will help.
