Few weeks ago, I was visiting my friend,on a brand new houses complex, still under construction. My AWD SUV parked in front of his garage, but my rear wheel few inches on the sidewalk. The complex doesnt have any tow away zone sign when you get in, the street of my friend house doesnt have any sign that prohibit parking on the sidewalk.
My car get towed improperly (from the rear) by a towing company. This company didnt want to release my car the same night because they were open from 6 AM to 8 PM even if they tow cars 24x7. I had to call the cops, to get my car back around .
The following day, I notice a strange noise long story short I brought the car to two different garage and towing truck broke the differential. It also damage tires and shock absorber.
Lucky me, my friends next door neighbor has security cameras and I was able to get the towing video a week later. This is pure car brutality
My insurance company can cover the damage, as a collision claim. The video and mechanics estimate prove that I am not in fault. However, this will increase my insurance premiums for the next 3 to 5 years. And insurance is not able to tell me right now how much the increase is going to be.
Ive reached out the towing company. My insurance did to. We notify them the incident and forward the video. Now the multiple managers run away from me, do not return my call. I dont think they are willing to pay for the damage.
The amount of repairs will probably be around $ 4500. I now my case is solid but to go to small claim court. But it is a lot to pay upfront not being 100 % sure I will get my money back.
If I let my insurance take care of the repairs and go after the towing company to get at least my deductible back, may I sue the towing company on my end for the insurance premium increase that are going to occurs for the next 3 to 5 years ?
