My question involves real estate located in the State of: Life Tenant vs. Remainderman
I really would like citations to TN law or cases.
John Doe died. Left Life Estate to fiance with a step-grandhild of his gaining ownership in 20 years.
Said step-grandchild is a minor. Parent, paramor, step-grandchild and sibilings had lived in basement for sometime before John Doe died. Fiance had lived in upstairs with John Doe for more than double that time.
Step-grandchild and others left for 4 months. Leaving a huge mess-food, furniture, trash, etc. including animal feces, fleas and roaches. LEO had informed Life Tenant they could not go downstairs. Life Tenant can not get to their hot water heater nor their breaker box.
Mother of Remainderman has been kicked of the 4 month rental for not paying rents due nor utilities, and being nasty.
They have moved back into basement of house while Life Tenant was at work. Running an electric heater instead of using the gas wall heater and of course running up all the utilities.
What rights does the Life Tenant have? Sheriff's deputies say none. Mother of minor remainderman had attorney write a letter months ago to Life Tenant stating that because they had been living there before John Doe died, nobody could have ask them to leave but that they had advised them to pay Life Tenant 1/2 the utility costs. There are 5 of them and only 1 Life Tenant.
