My question involves estate proceedings in the state of: Pennsylvania
Hello, I live in Virginia. My father died in 2016 in a nursing home in PA. My mother died in February of 2018 in Pennsylvania.
Neither my mother nor father had a will.
While researching the intestate laws of PA, it is clear my mother was the beneficiary of their home. When my mother died though, the laws indicate that the the property is split evenly between my brother and I as we are the only two children. There are no other children either living or deceased so the per stirpes rules don't come into effect.
In addition to no will, my mother had no money, no life insurance, no bank accounts and no retirement accounts. My brother moved into the house that we inherited.
I am trying to sell the house to my brother for $5,000. My brother and I split the cost of the funeral but I paid solely for the wake/repast. $5,000 will cover both of the expenses I paid and he gets the house plus any personal property within that I have no desire to transport from PA to VA. This includes a baby grand piano, a grandfather clock, my father's hunting shotguns, real leather living room suite - so not cheap items).
I have no desire to insist on the sale of the house and even if I did, I don't think my brother would agree since he's living there. My brother is trying to sell his own house but there are currently no "bites" on the listing. In the meantime, although my brother has paid the taxes due on his own home, he has not paid the taxes due on my parents' home in which he is living. I'm pretty sure that means that the county in PA can come after me for the taxes. And if I don't pay them, I'm also pretty sure they'll take them out of my expected tax refund.
I hope I gave enough information for somebody to assist. I cannot find a lawyer here in VA that can help for obvious reasons. But I also cannot find a lawyer in PA that can help either. Is there anybody out there that can point me in the right direction? How can I sell this house (and it's contents) to him for this paltry amount? The estimate on my parents house is currently $145K so I think I'm being more than fair.
Please - any assistance?
