My question involves court procedures for the state of: New York.
My wife works for a nursing facility and she is being asked to appear for deposition on a case involving the facility. The court, however, keeps postponing the hearing. We, on the other hand, have already scheduled a family vacation for a few days next month. So, while I hope that the hearing won’t interfere with it, I want to know what to do if they ask her to appear in court (or wherever it takes place) on the day we’ve scheduled our vacation for. Rescheduling the vacation would be very costly, and, considering the constraints at my work, it would be difficult to pick another date. So, does my wife have a right to legally postpone or decline her appearance because of that? Please let me know.
