Establishing Paternity: Pregnant by Another Man Before My Divorce Was Final, but Now It is Final

My question involves paternity law for the State of: Both Colorado and Virginia,

I have a friend who was married in VA, filed for divorce, has not been with spouse since Nov, 2016. This past Nov. her divorce was final, (ex husband took long time to sign paperwork). While she was still married she dated and conceived with another man. She just had her baby last week in Colorado, their law states that you have to be legally divorced for 300 days before the father's name can be put on the birth certificate, since her divorce was only finalized in Nov., they will not put the father's name on the certificate and it is assumed her ex husband is the father unless he signs a paper stating other wise. He knew she was dating and new of the pregnancy, now he will not sign the paper until he speaks with a divorce lawyer because he states she committed adultery and wants to know his legal rights. The divorce papers had nothing in them about children, and the divorce is now final. Is there anything he can do about this? Colorado also does not do blood test in these cases to establish paternity. Is there anything else she can do?
