My question involves a child custody case from the State of: Washington
Hi, I have been separated from my husband for almost seven years and I have been trying reach an agreement with him on a divorce for over a year now. It's not working out, though, as he is doing everything he can to put hurdles in the way of the process. So right now I am facing the likelihood of an expensive and conflictive contested divorce that could take a long time.
The problem is, though, that I am considering relocating this summer to my home country with my child. (My husband is a foreign citizen and green card holder, I am a dual national with US citizenship as secondary citizenship). I am the custodial parent, and my husband spends approximately 1-1.5 days per week with our child (whenever it suits him). I receive no child support.
My original plan was to get the divorce and then deal with relocation if that ends up the plan. But the delays that my husband has caused in the process mean that the window for doing it that way is almost disappearing.
So what I am wondering is whether - if it comes to that - I can file for a court order allowing me to move overseas even though I am not yet divorced, and then file for divorce at a later stage? (I believe that if that is possible the court would very likely allow me to move given our circumstances, but that is a different issue as to whether relocation before divorce would be allowed.)
