My question involves real estate located in the State of: Texas I have lived in my current residence for 27 years. When I bought the property I was made aware that there is a 14 inch easement on the east property line. When the developer constructed the driveway next door there was a mistake made that lead to the curved drive protruding 14 inches over the property line. The developer resolved this problem by granting the current easement on the east boundary of my lot. The easement document specifically states' The easement,rights, and privileges granted herein are to continue as long as said parcel is used for driveway purposes." The easement is filed at the courthouse and appears on every survey I have seen of my property as well as the property next door. The property next door sold just over a year ago. The new neighbor which has turned out to be "the neighbor from hell" is now in the process of building a shed or carport on the easement. Since the "neighbor' is obviously in breach of the terms of the agreement,can I now terminate the easement? If so,how should I proceed?
