Service and Repair: Is a Service Center's Liable for Damage to a Rusted Vehicle During a Lift

My question involves a consumer law issue in the State of: Maine
I think that I have found my answer anyways, but what it is, I had purchased a set of tires for my van at a local Sam's Club and with this comes the need to have these tires rotated every 6000 to 8000 miles to keep the warranty valid (it's free at Sam's). So I went in a few weeks ago to have this service done at the proper interval. When we went to pick the vehicle back up, the mechanic was acting very oddly, he explained that when they tried to lift the van by the rocker panels, one side literally collapsed. He said that they did get the tires rotated, but that they had to "get creative" in order to get this accomplished. After I got the van back, one side indeed was pretty much crushed of course due to the amount of rust and corrosion that occurs up here in the rust belt of Maine. My question was going to be, how much liability would a Sam's Club assume in cases like this? Is it up to the consumer to make sure his vehicle is up to par? Should the Service Center be aware of this issue, especially in older cars and find an alternative way to do this service?

Anyways, after I started to sign up for this site, I went out and found the paperwork that they always give you at the counter. At the bottom of this paperwork, it clearly states that Sam's Club is not responsible for any damages that are incurred on any vehicle that is serviced at their facilities. Wow, good to know.....!

So in closing, I would say that I am pretty much stuck with this damage. I was planning on getting rid of this van this Spring anyways, but was hoping to run it up through this Winter, but now, I'm not sure that I can get an inspection sticker at the local garage now. I did ask about transferring the tire warranty (It's 90,000 miles and I am at around 30,000 miles now), and they said as long as it was the same type of vehicle and the tires stay on the same rims, they could honor this warranty.

Is there anything that can be done in a case such as this?
