Other Violations: Probationary License-Too Many Passengers Ticket

My question involves a traffic ticket from the state of: NJ.

Hey guys. Just wanted to inquire about a ticket my son received. He just got his license about 4 months ago. He was leaving high school for lunch and took an extra friend out with him making it 3 people in the car which is not allowed. I am not disputing the ticket but why he was pulled over. We both know he was wrong to have the extra friend in the car and it will not happen again, but...

The police officer said when he pulled my son over, "going kind of fast son, huh"? My son is a very cautious driver, or at least he seems to be. He is a good kid, very involved in sports in high school and has not been in trouble before. He has started keeping his hair on the long side with some of the other wrestlers. I can't help believe he was profiled. Anyway my question is this.

Can a police officer just pull him over and say "going kind of fast" or does he need evidence to support this? Radar etc. Why was he not given a ticket for speeding.

They also had a 2nd police car come to the seen and according to my son were real A holes about hole thing. Making them open up the back windows and looking in. This was all at 12 noon during the week.

Again I know he was wrong but would like to know how I should handle this as I have a court appearance next week. Thanks again all!!
