My question involves landlord-tenant law in the State of: Florida
3-4 months into my 12-month lease, I was informed that the owners are selling the home. After the previous owners sold thew home they provided the new owners with the last moth payment and security deposit. A few weeks later the new owners asked that we extend the lease by one month. We did not sign any documents or create a new lease, it was a verbal agreement that we would stay for another month which I did agree to through text message. 3 months before we are expected to leave the home I applied for an apartment, paid the holding fee to secure an apartment, to make sure I would have a place and discussed with the apartment community I would need a place by a specific date, the date the new owners and I agreed would be our move out date. The new owners also asked that I move out a few days before so that she could clean, etc. and that she would pro-rate the days. The apartment complex advised they would let me know when the apartment I was looking for became available, being that it was about 3 weeks away from the month I will be moving I contacted the apartment complex that advised because of new management I would need to submit the application again, etc. I was upset because I was no longer guaranteed a place, after doing the process again, they advised they only had a place available at the end of the month which is a few weeks before the time I verbally agreed to be out of the house with the landlord but honors my originally lease contract. I informed the landlord right away. The new owner seemed upset and I was not sure why, I know I agreed to a certain date but it was 3 weeks earlier. I asked if she would pro-rate the days and she said no.
My concern here is that I am going to be out on the 6th and she is only agreeing to pro-rate the days of the 26th to the 31st. I paid for the month of December and will be out by January 6th, she has the last month and security that was transferred to her from the previous owners. She intends to occupy the property when we leave. Should she be able to keep the duplicate last month payment?
