My question involves vehicle registration or title in the state of: PA
Hello all experts.
I recently decided to sell a vehicle that had to many issues expensewise for me fix. A guy responded to an online add an said he wanted it for himself to fix and use. He refused to goto my local notary and said he had a friend/family member who owned one he used and that already had all his info so he wanted to use that particular notary(for reasons of it being easier cause he was already on file with them with his info?)
So I went along with it, with him assuring me it was going to be a regular normal title transfer.
When I went to the notary the following day at the times we arranged to meet he was unable to be there but copies of his ID were and he presigned a form that is sent in for his purpose of applying for a new title ownership for the car. This is the only document they would provide a copy of at this notary as prove of the transfer, not a copy of the actual title signed, notarized with both our names on it...because he was not present to sign this at the time and they only took my signature and notarized it ...which is a legal process in Pa.
However, when I got home later that eve and studied that application form they gave me as proff as of this transaction they left numbers out of the VIN on that form and it threw up a red flag in my head.
I called there office phone left a message about it and contacted local DMV in mornng to ask if this was ok or even a thing that is done at times to make filling out these apps/forms quicker and the DMV said no it would be rejected and returned to them...leaving the title in my name longer than it already would be by way of there means of sending it to the DMV which already was concerning me cause they were saying they still do it by courier and most notaries here now in PA have a direct link to the main DMV;s computer systems and they can automatic start the process online(not fully completing the process) but at least start it legally on record that the title is being transferred from one owner to another.
After speaking to them further at this notary they started telling me another story about when there courier leaves to go officially drop this paper work for reg at the DMV it conflicted an was completely different than what they originally told me the day before...and it was the same office rep speaking to me. It seemed as if he started to get frustrated that I was questioning them to send me an actual copy of the title signed and a corrcted version of these forms and documents with the correct notarized info on them.
Then I recalled the buyer telling m that he was a reseller of cars at times fixes them an sells them but he did insist he was going to fix this one and drive it tat he needed a car for the winter. I assured him it did not matter to me what he did with the car as long as the title was transferred out of my name.
So I finally gathered or figure on a hunch that they must work together notary/buyer and hold/tie up the titles for a period of time until cars can be repaired or resold to another buyer abd avoid paying title transfer fees twice.
I tred asking the DMV what to do, they were not helpful at all. They said check back in a month or so to see if the title was transferred out of my name. lol ...yea right and leave it in my name all that time with liability for it in my name still without my tag on it but still in my name. The vehicle was in extremely poor codition but wa drivable and with one quick fairly expensive repair it will be drivable daily.
PA has a cancelation of registration that you can idicate as a reason wy in a small box as having sold the vehicle. This had trivial online infoabout it being a release of liabilty for the vehicle after having sold it and the title still being not out of your name due to a new owners negligence. Also I have not contacted my insurance co yet to drop the car because I do not want to do so until I know its out of my name. This is a pretty recent transaction so I have not even contacted them in any way yet to tell them whats going on. IM trying to handle it first. So PA has no forms or officil process for release of liability as other states do.
I have a relative that works in local STATE LAW Enforecement and they are aware of this but I do not want them to get involved cause I dont want to really go down that road I would just rather do somethigng official to release my liability on the vehicle...
What do I do here?
Anybody suggest anything official I can do without really getting into a legal fight or mess?
