My question involves a traffic ticket from the state of: NJ
I received a made up seatbelt ticket for "not wearing a seatbelt" I was on a highway the cop was stopped roughly 30-40 feet way titled on an angle. The belt blends with my jacket id say 90% of the way its hard to tell im wearing one. I was also learning forward (is there a law that says I must have my back against the seat?). While i have my doubts im going to win this I want to be as obnoxious and annoying as possible doing so. I already plain to keep pushing back the court date as much as i can. But i want to hit them with a legal technicality. I want to cast a drag net of things to file for discovery for.
Things like dash cam (don't care if thats a double edge sword showing how i acted ...no law states i have to show those things any respect...respect is earned not given because you put on a badge and act like a thug). Yes you are a thug when you lie to keep your job by meeting your quota oh im sorry quotas are illegal i mean your metrics. Yes others do lie to keep their job but not from taking others property doing so.
I also want to request any seatbelt tickets issued by him 24 hours prior and after my ticket and the disposition of those tickets. I'm already going after the notes as im sure he wrote such nice things about me. I also plain to call his credibility into question and request his disciplinary history. The one thing im not sure about is can i request the latest copy of his eye exam results? Since you can request discovery of the instrument used and its calibration his instrument would be his eyes and his calibration would be the eye test.
If i cant file for discovery of the eye exam results what about request of admission ? Can i send something "I am not 100% certain he wasn't wearing his seatbelt on day x that way if they dont respond they are admitting and thus creates doubt. I dont care that its such a little fine its a matter of principal why should i gave them a dime when they can just make up whatever they want.
Finally how many discovery requests do they have to send me..say I request 10 things and they send me 2..could i then take it to the next level and file for motion for compelling discovery or motion to dismiss?
