My question involves criminal law for the state of: Michigan.
I am wondering how to go about getting charges against my daughter expunged. She was charged with a felony and now will have a hard time finding a job and a place to live the rest of her life. She had delivered a drug to a friend that over dosed and died. The laws here in Michigan have changed so, if she had done what she did a little later , she would not have been charged with anything. As it is, she pled guilty to Delivery of a Narcotic Causing Death because she was in jail at the time awaiting trial on the charge and the court said "We will allow you to enter the drug court program if you plead guilty to Delivery of ....etc." That is kind of like extortion isn't it ??
Anyway, she is living with me right now, I am her father. She moved in with me in Nov. of 2016. I am planning on building a house in the spring of 2018 and do not want her to come with me. She can not find any place that will rent to her with a felony charge on her record.
Is there anyway to rectify the situation here ???
Sorry , left out some specifics. My daughter is 30 yrs old. She was charged and jailed in May of 2016. She spent 8 mths in jail and was released to my residence in November of 2016. She is no longer in the drug court program. She does have to attend meetings every Tuesday and counselling. She has a 30hr a week job , but, because she has to go to meetings every week is unable to get more hours.
