My question involves real estate located in the State of: CA
We are on 2 acres, originally part of a 15 acre parcel. The father sold his son 2 acres in the 1980's and granted an easement. We bought the 2 acres from the son 14 years ago and at that time the other 13 acres were sold to a developer. Soon after we moved in the developer contacted us about wanting our easement but the project never was developed. Then the 13 acres passed to another developer, then to a 3rd. Now the 3rd developer wants the easement, and they want to make us use their entry gate to access our property. This would mean we, our guests, and any deliveries would have to use their entry gate. Also it would make it inconvenient to drive to where I store feed for my chickens, and I walk my dogs down the easement to the mailbox every day. Now I would have to walk through the development to get my mail and I would not be able to let my dogs relieve themselves on their property. We would also have to move our mailbox into their 'bank' of mailboxes and may have to change our street address. Can we refuse to surrender our easement? We like things the way they are and see no benefits to surrendering our easement, and we see lots of negatives. We are scheduled to meet with the developer's rep on Dec. 12
