My question involves police conduct in the State of: Virginia
I was falsely accused of producing child pornography by an ex gf with the help of her new BF.
the police raided my home and photography studio. They seized all my computers, camera equipment, storage drives.. this happened 5 years ago.
since that time, nothing has happened.
They raided my house with a full swat team and busted down my door with rifles pointing at me at 5 in the morning. I was placed in cuffs, but never taken to jail. They interviewed me in my living room for a few hours and let me go. But my life was ruined. They took my cell phone, so i had to buy another. My doors all got messed up. I had to shut my business down. They interviewed all my friends and clients, whom all said the same thing, that i would not do what they claimed i did.
so now, 5 years later, I am trying to get my stuff back. I had the help of an attorney who said he was going to help me pro bono, and contacted the DA. They told him i can get my stuff back if i was willing to have them erase everything. I have years of client work saved that i need. countless portfolio work that would be wasted if they erased the HD. So i told them i would like to save the client folders.
this was their response:
We will start the wiping process on the items you list below.
As for the external hard drives, I want to clarify a few things.
First, with respect to the two Seagate Passport external hard drives:
1. Does MR. XXXXX believe that all that these hard drives contain are client materials? If the drives contain a mix of suspected contraband and client information, we will try to copy the client information from the device and return it on another medium.
2. Does the information involve one client or multiple clients?
3. If known, what are the name(s) of the client?
This information will make it easier for ****police department**** to attempt to locate the client information. Also, we will not be returning any material related to the complainant in this case. Although the metadata related to the pictures contradicts her, her testimony would be that she was under 18 when Mr. xxxx took pictures of her. Based on this, it is contraband, and we cant give it back.
Obviously they know she lied, but won't give me back my stuff.. i have spent countless amounts of money already trying to defend myself, and trying to fight off creditors when i shut my business down, so i'm tired, broke, and disappointed in our justice system.
