My question involves a consumer law issue in the State of: MA
My bathroom bathtub wall had a lose title caused water damage in the unit below us. It is a 5X7 small apartment bathroom. We agree to fix the ceiling for them as soon as possible. The unit below us refuse to have our contractor look at it. They say they have the rights to pick the one they like. I told them they can pick anyone they want to but the cost has to meet our expectation. (fair market price) They picked two quotes and are way too expensive for a 5x7 dry wall ceiling repair/fix. I refuse to pay because I never had a chance to have my contractor look at it. They didn't ask me to there when their contractor was there doing estimate. They told they are going to fix it weather or not I agree on the price. I told them I refuse to pay if I disagree on the cost. They will bring the case to the court.
Question: Who has the rights to hire contractor to do the repair? In my mind, I should involve get the contractor do the repair, they have the rights to exam finished product to meet their expectation. Am I right on this? What will happen in court if they have fixed the ceiling? I feel sick to pay inflated repair bill.
