the latest "Notice of Change of Terms of Tenancy" we were given by our landlords property management states the following:
All three leaseholders are named along with
"...and all other occupants in possession of the premises located at...(my address)
CHANGES
1. Your base rent will be $(x+y) effective 4-1-2017
Note: Of this amount, Mr. X is to pay x and Mr. & Mrs. Y are to pay y.
*Rent payment must be postmarked and mailed to our office by the 3rd of each month.
If your payment is postmarked on or after the 4th of each month, a $50 late fee will apply.
If your payment is postmarked after the 8th, a $100 late fee will apply.
Except as otherwise provided, all other terms of the tenancy remain in full force and effect."
Dated and signed by Owner/Agent for Owner
My question has two parts. Even though we are jointly and severally liable for the rent, if Mr. X does not pay his portion, does my landlord have to accept the payment of Y seeing as that is my obligation as a partial payment? Secondly, based on the verbage above, wouldn't he have to wait until the 4th of the month to post a pay rent or quit notice since technically rent is not due until the 3rd?
Lastly, if i do end up representing myself, how do i request documentation from the property management for anything sent to any of the leaseholders that i will need to present my answer to his UD case against me?
