My question involves a consumer law issue in the State of: Ohio
About 4 months ago my small welding & fabrication company was contracted to do work for a new gym opening up in our town.
We quoted $8,000 for the job to be completed in 3 months. The gym owner paid $4,000 up front for material costs & travel expenses.
Within the first couple weeks of fabricating the order in his building we had a $1,500 Welder stolen, our equipment was damaged, & we found out he had no security or insurance on his building or company. We took the loss, tried to be as understanding as possible & moved in shop to complete his order.
At this point he tried to contract us for a separate job, & when we tried to draft another quote & contract he became irate & wanted this new job to be included in the equipment cost. When we refused, since painting a building is different than welding some gym equipment, he began to threaten my company.
It was discovered he was going through steroid induced rage but thats not super important.
At this point there was still 2 months left before our due date & we have delivered 2 pieces of the order.
He fired my company point blank in a text message since we would not do the other contract for free. The money he already paid was not mentioned at all.
Its now a couple weeks past the due date, we did not deliver the remaining equipment.
He has seen something we made for another competing gym, & is now full on slandering us personally through all his social media, & threatening to sue our whole company & take away our homes & lives (even went so far as to mention taking away our childrens bed on social media).
He claims we stole materials & money from him since the job was never finished.
Does he have grounds to sue? Should I be concerned? The only paperwork that was ever signed was a quote my company has containing no due date & there is no mention of the cash transaction anywhere.
