My question involves criminal law for the state of: Texas
My girlfriend found a card in a parking lot that had $500 on it. We called the place that it was from and they didn't have anyone come looking for it. We held on to the card for over 2 months and the money was still on the card. So thinking we would never find the person it belonged to we decided to sell it. We sold it for $300 on craigslist. Met the guy in wal mart parking lot. He checked the balance online and called the store. The balance was there. Well about a month and a half passes by and then I get a call from the guy saying the card was empty. He called the place it was for and the original owner of the card had a receipt and the place reissued the card back to him. So the guy with the card I sold now has a zero balance because of this. Well now he threatening to make a police report if I don't pay him back. Will I get in trouble for this if he makes a report? It's not that I don't want to pay him back but I don't know if he spent the money and just told me that or if it really happened. I waited months and then he waited months. HE could be lying and just scamming me. What should I do? Should I pay him $300 or just let him make a police report. I don't want to get in trouble but I'm also not 100% he isn't scamming me. Did I break a law? Could I be prosecuted for this? Thanks in advance.
