My question involves court procedures for the state of: Texas
A girl crashed into my parked car (no one was in my car). She has no insurance (told the cop she did, I called her insurance afterwards to find out she's excluded). The local law enforcement states they cannot press charges as the incident occurred on private property (apartment complex). She admitted she hit my car, however stated she did so because she was scared. She stated she was attempting to escape from individuals chasing after her boyfriend, who was in the vehicle and fled after she crashed. I've no way to prove it but the girl/boyfriend were evading these individuals as a result of a drug deal gone wrong, which involved a shooting.
My plan is to sue the girl in order to claim restitution for the rental car and diminished value of my vehicle. These items are not covered under my insurance.
My questions/requests are as follow:
-Is law enforcement claim true re: inability to press charges?
-Do I have a good case in terms of claiming these restitutions I mentioned (rental/diminished value)?
-Any advice for a Small Claims court suit would be appreciated.
