My question involves a consumer law issue in the State of: Georgia
I ordered 2 case fans off of Newegg, total cost around $47. I got a newegg box today, but instead of my fans it was 3 5 TB hard drives ($150 a piece).
The tracking number on the box and my name were both correct (and matched newegg.com), the invoice in the box was not my name. My assumption is that the person packing the order screwed up and put the other customer's item into my box.
I'm not looking to get into a morale discussion on whether I should or should not keep the hard drives, I'm wondering legally if I have to send them back. I read up a little and found a snippit on the FTC website that says anything sent in error does not legally have to be returned. It also said that if your buyer has anything contractually in place that in an error you need to return it, that trumps the law. I read through anything I could find on newegg's site and see nothing that states this. So right now, I see the following options:
1) Keep the drives, order 2 more fans off of newegg
2) Call newegg, tell them that legally that they need to send me the items I ordered but I am refusing to send back what was sent in error (kind of a jerk move to pick this one but listing all I can think of)
3) Call newegg, get the fans, return the drives
Any advice?
