My question involves real estate located in the State of: Louisiana
I assumed a deed back in 2002. The owners were letting the home go into foreclosure. I reached out to the mortgage company and the owners and asked if I could get the home. We all agreed that I would take over the payments and I would get the home refinanced in my name. We all signed the deed at the mortgage company, everything was notarized, I paid an amount to catch up the note, paid the taxes at the assessors office, and everything was recorded in the courthouse. Since that time, there was a huge deal with the mortgage company - they went into Bankruptcy and that company no longer exists. There were many lawsuits filed against them and the company went out of business and another company took over the mortgage loan - Because of that and the issue with the deed, I was never able to get anyone to refinance for me, and the mortgage is still in the previous owners names. They have recently reached out to me via a lawyer requesting that I immediately refinance it or they will have the deed over-turned. Since I am unable to get it refinanced, I decided to leave the home and look for some place else to live due to all the threats from the lawyer that they will do a force sale in court and the owners told the current mortgage company to not accept any further calls from me regarding the mortgage and placed a passcode on the account. I went to the assessors the other day to remove the homestead exemption, and was told that both the home and land are in my name (deed states that I assumed the mortgage) and the previous owners have no rights to the property or home. What can I do? Can they just have the deed over-turned like that?
Thanks for any info provided....
ALSO: the previous owners have just recently started moving things back into the home without my permission. Isn't that illegal?
