My question involves landlord-tenant law in the State of: California
Thanks in advance for any input. I am in the process of leasing a corner of someone's 10 acre parcel which contains a garage/shop building. I want a long term lease which the owner has agreed to, 34 years. We want the long term lease as part of the agreement includes our making some fairly expensive repairs to the building and roof. Without the long term lease we won't invest the money into the building. I want to lease it through my S Corporation. All of the terms are set. My questions are these:
How should the lease agreement document be worded and signed so that it is a lease between the corporation and the land owners? The notary want me to sign my name, dba xxxx corp. Is that correct? I am the S Corp President but I want to make sure that the lease is still good if the company is sold or if I leave the company.
Is there any special verbiage that should be in the lease to make sure that it survives any change of ownership of the property?
