My question involves malpractice in the state of: New York.
I have a complicated situation with different legal implications I do not fully understand. I would appreciate any help from legal experts.
Who: My fiance, her Doctor, Probation Services.
My fiance moved out of my apartment last year and into an apartment paid for by her physician. The apartment is one block away from his medical practice. She first met him (3 years ago) at her mental health and substance abuse treatment program mandated by US Probation Dept. She has two years left on her 5-year term of supervised release. Physician was the supervising physician at the intensive (daily) outpatient treatment center. He no longer works there and she goes to another (weekly maintenance center). She now sees him in his private practice, where he prescribes her antidepressants, anti-anxiety, and more recently, an anti-psychotic.
Now, one year later, she wants to come back home (probably because the lease is almost up). She claims they were never intimate (doubtful), but she admits he has made several unwanted sexual advances. She is afraid to do or say anything out of fear it would cause problems with her probation. I want her to lawyer up or report it.
While our relationship has been severely damaged, our friendship has survived. Recently, she has been acting neurotic: paranoid, hallucinations, wild accusations, etc.
Some legal questions I have are:
1. Does she have a legal claim? Against MD? Treatment Center? Fed. Govt.?
2. Can family members sue for medical malpractice?(I did not want to marry or have kids while she was under supervision. The idea of a prison baby did not sit well with me). Otherwise, we were basically married.
3. Do I have a legal claim? For Intentional Infliction of Emotional Distress?
4. Could this cause problems with her probation? Or could it be a reason to end her probation early?
(She has been compliant without incident for the 3 years, notwithstanding this incident, which may be a violation. She notified them of her new address, but I doubt they know who is paying for it).
5. Could this be a violation of the terms of her supervised release?
6. Do I have standing to file a claim on her behalf?
7. Can she (or I) send the physician a draft complaint before filing in hopes of inducing an early settlement and avoid the hassle, expense, and embarrassment of litigation? (Note: MD is married with at least one daughter).
8. Should she be speaking to a lawyer?
9. Should she be telling her P.O.?
10. Maybe there is no legal claim or malpractice?
