Had a trial today for this infraction. Trial was scheduled at the exact same time as the solar eclipse, so I assume that's why PA didn't show up. I assumed I would get lucky and I could request dismissal based on lack of evidence.
But then, the session started, and the judge explained to us that if we wanted a contested hearing (as opposed to mitigation or deferral), we would have to request a continuance because the PA wasn't present. I wasn't really prepared for this, so I couldn't do much, and requested the continuance, with a trial in one month.
Is there anything I could have done?
