Default Boat Left After Closing in Tx
My question involves real estate located in the State of: Texas.
I recently purchased a property which was an estate. The seller or executor of the estate is the brother of the deceased original owner. When I first inquired about the property through my realtor I asked about the boat which was located on a lift in the deck out back of home. We were told it was sold already. Fast forward to closing, the boat was left along wth bikes and surfboards and some other small items, there was no addendum or exclusion in the contract regarding the boat or other items. Under Texas law it's my understanding that the boat and all other items are now mine since there was no amendment to the contract excluding the boat and it was left after closing. The boat had sat there for at least 3 years and the brother who was executor lives in California with no way of picking the boat up. He now wants me to purchase the boat from him and is asking for 9000 for a non running boat that he previously had two years to get rid of after his brother passed away. He had not sold the boat as originally stated, he told me he has the title which I even doubt. In summary, is the boat now considered mine with transfer of ownership of the home and all it's contents? What steps do I need to take with the executor of the estate (brother) or the listing agent?
