My question involves defamation in the state of: South Africa.
On friday there was a car accident with some wreckless and drugged up youngsters. One died and the other severley injured. I know the guy who was severley injured. I also know he sells drugs and was drinking that night. My family WAS friends with his family so ive known the boy for about 10 years and i know he is the possible cause of the accident.
I was contacted from a private investigator to try reveal if the severley injured boy was the driver and hed asked me to find out as a witness. Since it was the talk of the town everyone was prying talking and different stories came up to try cover for this boy blaming the institute which he drank at on social media and since i work there part time i defended the place saying wreckless behaviour cannot be condoned and a place cant be blamed which in turn had a negative effect and his friend swore at me publically on facebook.
A close family friend of theirs who i know and trust messaged me with details that could have helped the private investigator. And in doing so i mentioned to her that this boy has previously been in trouble for his selling of drugs, expelled from schools and his fathers sale of illegal steroids and that in the last year 3 other boys in his friend group who also use drugs were also killed in a car accident by the imsitute i work at leaving risk for people like me who travel home after people drink there and act like this.... she showed the message to this boys moms friend who then posted it all over social media using my private company name which the institute hires my services for marketing the place.
Her message was that i am a useless excuse for a human by lying which i didnt, (these are hard facts and more than one have died as a result of this boy and his drug circle.) And posted a screenshot of my message publically on a page with 2000 followers. Saying she has advised the parents of the boy to take legal action.
When i contacted the private investigator he says its defamation but says its because no one has spoken up about this boy out of fear. Which in my opinion could save many more people if he is punished including myself on the same roads.
Can they sue me for this and is it defamation to post publically about me and the actions they want to forward? I worry because all of the town know this boy and most people my age used drugs with him and are calling me a liar and making people hate me when it really is the truth and i for one am tired of the deaths caused by wreckless druggies who think they are invincible. Do i have a leg to stand on?
