(Irc) Indian River County Noise

Could not figure out which category to post under. . .help. . .

IRC (Indian River County) FL noise ordinances are well defined and include exceptions for
"Noises resulting from an air conditioner, ....and similar outdoor mechanical equipment....".

A small number of IRC residents live adjacent to industrial grade HVAC equipment whose noise
and vibrations have become excessive. The residents and equipment are all in a residential area.

We had noise analysis done by a qualified engineer and his report states that the equipment is
in violation of noise ordinance.

IRC tells us that the equipment was "approved" and is now exempt from enforcement.

While exposed to the noise my wife was diagnosed with hypertension, in remission after we left.

1. How do we get IRC to answer this simple question in writing regarding "approved"
industrial grade HVAC equipment running 7x 24 x 365 in a residential area:

Question: "After IRC approval, are there any limits to the noise allowed from the equipment?"

2. What approach is appropriate if we pursue legal action against IRC?

3. Do county governments ever lose in court / pay legal cost of plaintiff?
