I have an eCommerce business and I am wondering if it is legal for me to prevent sales in my state to avoid collecting sales tax? Or is this some form of tax evasion?
Second, if I have a partner who simply owns 50% of the business but they live out of state, do we have nexus in both states, or just the state where the business operates out of? The other owner will not be selling, holding goods, posting fliers or anything like that. They'll simply own their 50%.
