Hello, I was on student visa (F-1) and later got pregnant and gave birth here to my baby. She is a US citizen. Me and her dad were never married. He is on her birth certificate and she got his last name. I have restraining order against him for five years and one year was given for the baby. He can still visit her through a special company once a week or in two weeks, monitored visit and we don't see each other. No contact or by third parties either. My grace period will expire soon and I will have to overstay due to custodial orders and criminal charge against baby's dad. I have been supporting and taking care of this baby since she was born. He invested nothing. Still married to his soon-to-be ex-wife and got two other children that can barely take care of. He also got DUI and no license for two years. Still driving. Question is, can I go home with the baby? What is a possible outcome from paternity case?
