My question involves paternity law for the State of: California.
I was recently served the FL-145 form interrogatories by my ex girlfriend. We were never married. She has an 8 year old child. She married another man last year. She and her current husband both signed the voluntary Declaration of Paternity 8 years ago when the child was born. The man recently file for a divorce listing the child as a minor. I am not aware of any court ruling that says that I am the legal father. I assume that her husband is the legal father. The couple and child live together. They have changed the child last name from his last name to her last name, applied for the child passport and other things that only legal parents can do. She is trying to get support from me for the child. There is a case number on the FL-145 form. I search the Santa Clara Superior Court for the case but found none. I also search for her name. I found the ongoing divorce case between her current husband and her. I can not find any case with her my name. How can I find out if there is a real court case against me? Thanks.
