Repair and Maintenance: Who's Responsible for Water Damage to My Bathroom Ceiling

My question involves real estate located in the State of: California


Hey there, this is very stressful and I appreciate any help in advance!

Here's what happened. I noticed there's water damage sign in my bathroom ceiling one day and I immediately contacted the HOA. After some investigations HOA and the homeowner above figured out that the leak is from the angle stop (which seems have manufacture defect) under the sink. The homeowner above both mentioned that the leak is almost invisible within their unit. My insurance company declined coverage because this is a long term leak (the leak amount is very small and that's why it's not visible and took a while for me to even be able to notice), and the homeowner above's insurance declined the coverage because it's a leak is almost invisible and it's due to a defect product thus the homeowner above has no liability in this.

I think they are bull shitting. The total of bill (water damage removal + contracting) is around $10,000. Is my understanding correct that they should be responsible for 100% of my damage or we still have to check CC&R?
