My question involves estate proceedings in the state of: North Dakota
My mother currently is in a long term care facility with dementia. My father is currently the attorney-in-fact for my mother granted with a durable power of attorney form and I'm to be the attorney-in-fact if he is incapacitated. They have a joint checking account from which the medical bills are being paid. I have no POA with my father. If my father is incapacitated I will be able to pay my mother's medical bills from that account, but if my father also ends up in a long term care facility and incapacitated, will I be able to pays his bills too or do I also need to file a separate durable POA form with my father?
