My question involves malpractice in the state of: Illinois
Recently I accidently broke the C-Pap machine I had been using in excess of 8 + years. During all that time neither the Doctor nor the company that provide the machine ever asked if the machine was working properly, never asked to have the machine examined to see if it was providing the correct pressure or humidity. Now in order for them to replace the machine they want me to spend a lot of money getting a new sleep study done. My opinion is that this is an unnecessary expense on my part and if the machine I had was good enough to work for 8 + years with no one checking on it then why I can't I get a new one with out having to do a sleep study. Would I have case against the medical field with these circumstances?
