My question involves a child custody case from the State of: Texas

I am in the middle of a somewhat protracted divorce. The relationship with the ex pretty much ended 18 months ago. I asked for a divorce, he asked me not to kick him out right away so he could get his act together, and I agreed (stupidy, but another story). So this divorce has taken longer than it should have.

I pay all the bills, am an upstanding citizen, yada yada. We are going to mediation, and I am tending towards going the 50/50 joint conservatorship, 50/50 time thing.

In the meantime, I eventually met someone different. New guy has a felony record for theft from some years back. (Plus some traffic violations, also old.) Nothing violent, no drug convictions, nothing with kids, not a sex offender. We are dating, and do not live together.

At some point in the future, after this divorce is final, we might want to, however. The soon (hopefully) to be ex, however, has threatened to take me back to court if that day ever comes.

I am interested in thoughts and opinions on what he could actually challenge about custody, and how likely it would be he would be successful?
