My question involves criminal law for the state of: New Hampshire
Recently I was pulled over during a snow storm for "snow obstructing my license plate" during the stop the officer "noticed the smell of alcohol coming from the vehicle" I was asked to do the three field sobriety tests; the HGN (eye test), the one legged stand and count, and the line test (9 pace and pivot). I was then asked to take a breathalyzer test which I respectfully refused. I was then arrested for DWI for having 4/6 "identifiers" during the HGN (eye) test.
Fortunately I have video footage on two CCTV channels showing me cleaning the snow from my vehicle including my license plate. The stop occurred approximately 5 minutes from where the footage was recorded.
Could this video footage help in having the case dismissed due to weather conditions effecting the obstruction of the license plate?
